Last updated 10 September 2026

These Terms and Conditions govern access to https://www.frenckenberger.com and purchases made from FRENCKENBERGER GmbH. Please read them before placing an order. Mandatory consumer rights under applicable law remain unaffected.

1  About us

The website and online shop are operated by FRENCKENBERGER GmbH, Schlyffistrasse 10, 8806 Bäch, Switzerland. You can contact us at info@frenckenberger.com.

In these Terms, “we”, “us” and “our” mean FRENCKENBERGER GmbH. “You” means any person who visits the website or places an order.

2  Application of these Terms

These Terms apply to the use of our website and to retail orders placed through it. Separate terms may apply to wholesale, bespoke, made-to-order or other business transactions if agreed in writing.

By placing an order, you confirm that you have legal capacity to enter into the contract and that the information you provide is complete and accurate. If you are under the age of majority where you live, you may order only with the consent of a parent or legal guardian.

3  Products and availability

We take reasonable care to describe and display our products accurately. Colours and textures, particularly natural fibres and handcrafted finishes, may vary slightly from images because of screen settings, lighting, materials and the individual nature of production. Such minor variations do not constitute defects.

All products are subject to availability. We may limit quantities, withdraw products or correct descriptions at any time. If an ordered product is unavailable, we will inform you and refund any amount paid for that product.

4  Prices taxes and duties

Prices are shown in the currency selected on the website. The checkout will state whether applicable VAT or sales tax is included and will show delivery charges before you submit the order.

For international deliveries, import duties, customs charges and local taxes may apply unless checkout expressly states that the order is delivered duty paid. Where these amounts are not collected by us, you are responsible for paying them to the relevant authority or carrier.

We may change prices at any time before an order is accepted. If a product is incorrectly priced because of an obvious error, we may reject or cancel the order and refund any payment.

5  Ordering and contract formation

The website allows you to review and correct your order before submitting it. By selecting the final order button, you make a binding offer to purchase the products in your basket and accept these Terms.

We will promptly send an electronic acknowledgement after receiving your order. This acknowledgement confirms receipt but does not necessarily mean that we have accepted the order. A contract is formed when we send an order acceptance or shipping confirmation, or when we dispatch the products, whichever occurs first.

We may refuse or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment failure, delivery restrictions, an obvious pricing error or a breach of these Terms. If payment has already been taken, we will refund the relevant amount.

6  Payment

Available payment methods are displayed at checkout. Payment services may be provided by independent payment providers and may be subject to their own terms and privacy notices.

You confirm that you are authorised to use the selected payment method. We may carry out payment authorisation and fraud-prevention checks. Your payment method may be authorised when you place the order and charged when the order is accepted, prepared or dispatched, depending on the method selected.

7  Delivery

Available destinations, delivery options, estimated times and charges are shown at checkout. Delivery dates are estimates unless we expressly agree otherwise. We will inform you of material delays and provide any remedies required by applicable law.

You are responsible for providing a complete and accurate delivery address. Risk passes to you when the products are delivered to you or to a person you designate, except where applicable law provides otherwise. If you nominate a safe place, neighbour, forwarding service or other third party after delivery by our carrier, responsibility may pass when delivery is made as instructed.

If a parcel is unclaimed, refused or returned because of an incorrect address, we may deduct reasonable return, storage or redelivery costs from any refund where permitted by law.

8  Cancellations returns and exchanges

We accept returns from customers worldwide. You must request the return within 14 days of receiving your order and follow the return instructions we provide. If a mandatory statutory cancellation or withdrawal right gives you a longer period or additional rights, those rights remain unaffected.

Returned products must be unworn, unused, unwashed and undamaged, with all original tags and packaging. You may handle a product only as reasonably necessary to establish its nature, characteristics and fit. We may reduce a refund to reflect loss in value caused by handling beyond this.

For returns sent from an address within the European Union, we will cover the return shipping cost and any taxes or customs duties charged specifically in connection with the return. You must use the return method and documentation we provide. We are not responsible for additional costs caused by using another carrier or return method without our prior agreement.

For returns sent from an address outside the European Union, the return shipping cost and any taxes or customs duties charged in connection with the return will be deducted from your refund after the product has been received and inspected. We will provide or confirm the applicable return method before the product is sent back.

The original outbound delivery charge is separate from the cost of returning the product. It will be refunded only where required by applicable law. Exchanges are subject to availability and may be handled by returning the original order and placing a new order.

Returns are not accepted for personalised, altered, made-to-order or bespoke products, sealed goods that are not suitable for return for health or hygiene reasons once unsealed, or any other category excluded by applicable law, except where the product is faulty or the exclusion is not legally permitted.

To start a return, contact info@frenckenberger.com within the 14-day return period and wait for our instructions before sending the product. Refunds are made to the original payment method after the return has been received and inspected, normally within 14 days, subject to the permitted deductions above and applicable law.

9  Faulty or incorrect products

Please inspect your order promptly and contact info@frenckenberger.com if a product is damaged, defective or incorrect. Include the order number and clear photographs where possible.

Your legal rights concerning non-conforming or defective goods remain unaffected. Depending on the circumstances and applicable law, the available remedy may include repair, replacement, price reduction, cancellation or refund. Damage caused by misuse, failure to follow care instructions, accidental damage or normal wear is not a defect.

10  Pre-orders and made-to-order products

Products marked as pre-order or made-to-order have an estimated dispatch date on the product page or order confirmation. Estimates may change for production or supply reasons. If there is a material delay, we will notify you and provide any cancellation right required by law.

If an order contains both available and pre-order items, we may ship them together when all items are ready or in separate parcels.

11  Promotions gift cards and discount codes

Promotions and discount codes are subject to the terms stated with the offer. Unless stated otherwise, they cannot be combined, exchanged for cash or applied retrospectively. We may refuse or cancel use that is fraudulent, unauthorised or contrary to the offer terms.

Any gift card terms, validity period and territorial restrictions will be stated when the card is purchased. Mandatory local rules on expiry and reimbursement prevail.

12  Website accounts and acceptable use

You are responsible for keeping account credentials confidential and for activity under your account. Tell us promptly if you suspect unauthorised access.

You must not misuse the website, interfere with its operation, introduce malicious code, attempt unauthorised access, scrape or extract data at scale, use the website for unlawful purposes, or infringe the rights of another person. We may restrict or terminate access where reasonably necessary to protect the website, our users or our rights.

13  Intellectual property

The website and its contents, including the FRENCKENBERGER name, trade marks, designs, text, photographs, graphics, video, software and layout, are owned by us or licensed to us and are protected by intellectual property laws.

You may view the website and download or print limited extracts for personal, non-commercial use. No content may be copied, reproduced, modified, distributed, published, commercially exploited or used to train an automated system without prior written permission from the relevant rights holder.

14  Third-party links and services

The website may link to or integrate services operated by third parties. We do not control third-party websites and are not responsible for their content, availability or practices. Your use of them may be governed by separate terms.

15  Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intent or gross negligence, death or personal injury caused by negligence, fraud, or mandatory product-liability and consumer-protection rights.

Subject to the previous paragraph, we are not liable for losses that were not reasonably foreseeable when the contract was formed, for losses caused by events outside our reasonable control, or for business losses arising from a consumer purchase. If you use the website or products for business purposes, we exclude liability for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or data to the fullest extent permitted by law.

We do not guarantee that the website will always be available or free from errors, but this does not affect obligations that cannot be excluded under applicable law.

16  Privacy

We process personal data as described in our Privacy Policy and use cookies and similar technologies as described in our cookie information or consent tool.

17  Changes to these Terms

We may update these Terms to reflect changes in law, our services or business practices. The version in force when your order is accepted applies to that order. Material changes affecting existing contracts will apply only where legally permitted and with any notice required by law.

18  Governing law and jurisdiction

These Terms and any contract with us are governed by substantive Swiss law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

The courts at our registered office have jurisdiction, subject always to any mandatory right a consumer has to bring or defend proceedings in the courts of their place of residence and to any other mandatory consumer-protection law. If you reside outside Switzerland, mandatory protections of the country in which you habitually reside remain unaffected where they apply.

19  General

If any provision is invalid or unenforceable, the remaining provisions remain effective. A failure or delay in enforcing a right is not a waiver. You may not transfer your contract without our consent, except where applicable law allows. We may transfer our rights or obligations as part of a reorganisation, sale or transfer of our business, provided this does not reduce your mandatory rights.
